Lawyer for OBGYN Sexual Abuse by Dr. Blaine McGraw in Hawaii

Attorney for Medical Malpractice at Tripler Army Medical Center in Honolulu

There are few issues that are as concerning as the abuse of patients by doctors. Patients should be able to trust that they will receive quality medical care and that doctors will listen to their concerns. This is especially true for women who receive gynecological treatment, since they are often in vulnerable positions during examinations, and the steps followed during treatment can affect their own health and the outcomes of their pregnancies.

When OBGYNs mistreat patients, they can cause long-lasting harm. In addition to the medical concerns that may affect patients who do not receive the proper treatment, abuse by doctors can lead to serious emotional trauma. When patients learn about abuse that may have taken place while they were receiving treatment, they will need to understand what options are available to them.

Sexual abuse is an issue that has affected numerous patients of Dr. Blaine McGraw, who worked at medical facilities on U.S. Army bases. While Dr. McGraw most recently served as an OBGYN at the Army base in Fort Hood, Texas, he previously provided care for patients at Tripler Army Medical Center in Honolulu, Hawaii. Patients who received treatment from Dr. McGraw in Hawaii may be eligible to file medical malpractice claims under the Federal Tort Claims Act.

Allegations of Sexual Abuse Against Dr. Blaine McGraw

In October of 2017, Dr. McGraw was suspended by the Army due to complaints by patients. While multiple patients had reported that McGraw had engaged in inappropriate behavior, the Army had not done anything in response. When an Army veteran who was the husband of one patient fought to make sure that complaints were taken seriously, the Army investigated Dr. McGraw and found evidence that indicated that he may have engaged in a longstanding pattern of abuse that could have affected hundreds or even thousands of patients.

Dr. McGraw has been accused of acting inappropriately during examinations, including performing unnecessary vaginal and breast examinations. One woman claimed that he pressured her into receiving a pelvic exam that he claimed was mandatory, even though the purpose of her appointment was to address a sinus infection that occurred during her pregnancy.

The accusations also include claims that Dr. McGraw secretly took photos and videos of women during breast and vaginal examinations. Investigators have uncovered thousands of images and videos of patients on McGraw's devices, and they are working to identify the women who have been affected.

While the most recent complaints against Dr. McGraw were related to treatment he provided while serving in Fort Hood, Texas, he also received complaints while serving on an Army base in Hawaii. He worked at Tripler Army Medical Center between 2019 and 2023, but even though complaints were made about his behavior, the Army allowed him to continue treating patients, exposing many more people to the risk of abuse.

Medical Malpractice Claims Against the Army

Abuse of patients by doctors is a form of medical malpractice. Patients who have suffered harm may have legal options, including filing claims under the Federal Tort Claims Act. However, doing so can be a complex process, and the proper procedures must be followed to provide evidence of the harm that a victim has suffered. In general, there is a two-year deadline for these types of claims, which may apply after the alleged abuse occurred or after a victim learned about the abuse. An attorney with experience in these matters can provide representation to ensure that claims will be handled correctly.
